Binding decisions of the European Data Protection Board under Article 65 of the GDPR may be challenged before the EU Courts.
On 10 February, the Court of Justice of the European Union held that binding decisions of the European Data Protection Board under Article 65 of the General Data Protection Regulation may be challenged before the EU Courts (see WhatsApp Ireland Ltd v European Data Protection Board – C-97/23 P).
