On 10 March 2025, the Belgian Data Protection Authority published its new draft recommendation on direct marketing.
On 10 March 2025, the Belgian Data Protection Authority published its new draft recommendation on direct marketing which updates its existing recommendation 01/2020. This updated recommendation considers new case law and decisions of the dispute resolution board as well EDPB guidelines. The most important changes are a revised definition of direct marketing, clarifications on consent requirements, “consent or pay” models and retention periods, and recommendations on ensuring that your direct marketing practices align with the latest legal standards.
