Marc Freedman focuses on UK and EU competition law.

Marc’s practice includes advising clients on complex UK, EU and multi-jurisdictional merger control (including Phase 2 investigations and appeals), digital markets regulation, FDI screening, antitrust investigations, abuse of dominance, market studies and market investigations.  His experience spans a wide range of sectors, including digital/tech, e-commerce, consumer products, food and drink, financial services (including fintech), pharmaceuticals and media.

Marc has particular expertise in relation to UK merger control, having successfully assisted clients in numerous merger investigations before the UK’s Competition and Markets Authority (CMA).  Moreover, Marc has previously completed a year-long secondment to the CMA’s mergers unit, during which he worked on multiple complex CMA merger investigations and sat on the CMA’s Mergers Intelligence Committee.

Marc has also recently completed a six-month secondment to the in-house competition team of a leading global pharmaceutical company.

Work highlights

  1. Involvement in numerous complex and high-profile UK merger investigations, with recent examples including Cargotec/Konecranes, Ali/Welbilt, JD Sports/Footasylum and FNZ/GBST.
  2. Assisting various clients on a number of recent UK and EU antitrust investigations and sector inquiries involving major digital platforms (including App Stores, Mobile Browsers, Facebook Marketplace, Amazon Buy Box, Google Adtech, Cloud Services – and, most recently, each of the CMA’s first-ever SMS designation investigations).
  3. Advising a major cross-channel ferry operator on its successful appeal to the Court of Appeal – and previous appeal before the Competition Appeal Tribunal – challenging the Competition Commission (later, the CMA) merger decision in Eurotunnel/SeaFrance.
  4. Advising a major international financial institution in relation to the first-ever antitrust investigation conducted by the UK’s Financial Conduct Authority (FCA).
  5. Advising a major international financial institution in relation to the FCA’s asset management market study.
