Van Bael & Bellis obtained the annulment of Commission Regulation (EU) 2022/2390 amending the countervailing duty imposed on imports of rainbow trout originating in Türkiye

In a judgment issued yesterday, the General Court of the European Union upheld the application filed by Van Bael & Bellis on behalf of the Turkish exporters association EIB and its members, and annulled Commission Implementing Regulation (EU) 2022/2390 amending the definitive countervailing duty imposed on imports of certain rainbow trout originating in Türkiye following a partial interim review of the measures.
The General Court found that the allocation methodology followed by the Commission in order to calculate the subsidy amount attributable to the product under investigation was vitiated, and resulted in an artificial increase of the subsidy margin of Gümüșdoğa, one of the sampled Turkish exporting producers. In turn, this error vitiated the calculation of the countervailing duty rate applicable to non-sampled producers. In order to comply with the General Court’s judgement, the Commission will have now to recalculate the subsidy rate of Gümüșdoğa as well as the residual rate for non-sampled exporters.
