Van Bael & Bellis counsel Koen T’Syen and Valérie Lefever have authored an article on the current state of merger control in Belgium. The article discusses the increasingly assertive approach to merger control of the Belgian Competition Authority (BCA). The BCA has more resources and is keener than ever to take action against any transaction, however small, that might raise competition law concerns, and to carry out extensive market analyses. As the article explains, the BCA’s ambitious merger control agenda is apparent in its daily operations and recent decisional practice. The new agenda is also actively propagated by the BCA’s new leadership, including Competition Prosecutor General Damien Gerard and new President Axel Desmedt (see also, Belgian Antitrust Watch of 25 October 2024).
The article was published in the October edition of the Dutch journal “Mededingingsrecht in de Praktijk” (MP 2024/5), a leading competition law journal discussing competition law developments in the Netherlands and beyond.
