VBB launches new guide on the EU Foreign Subsidies Regulation

Our cross-practice EU Foreign Subsidies Regulation (FSR) taskforce, led by competition partner Andreas Reindl and trade partner Isabelle Van Damme, has authored The EU Foreign Subsidies Regulation, an in-depth guide to the FSR published by specialist competition law and economics publisher Concurrences.
A market first, the handbook is aimed at in-house counsel and private practitioners and provides a comprehensive account of the FSR’s scope, application and control mechanisms, outlining how it affects transactions in the EU and the practical due diligence that companies should undertake in the context of a merger, participation in a public procurement procedure, or other activities in the EU. It also considers the FSR’s interaction with related areas, such as EU merger control, FDI regimes, and the EU’s trade defence instruments.
Arancha González, Dean, Paris School of International Affairs, Sciences Po, wrote the foreword. Frédéric Jenny, Chair of the OECD Competition Committee, Former Chair of the WTO Working Group on Trade and Competition Policy, Emeritus Professor of Economics, ESSEC Business School, wrote the introduction.
The handbook was officially launched on 30 January 2024 at a reception in our Brussels office. It is available in hardcover and online (for Concurrences subscribers) via the Concurrences website.
Our FSR taskforce combines specialised knowledge of EU merger control, international trade law and State aid – the three disciplines that sit at the heart of the FSR – and a detailed understanding of how the regime is likely to be enforced to advise clients on risk assessment and compliance with their FSR obligations.
