Spain - Competition Scrutiny of Digital Pharmaceutical Logistics Tools for Pharmacies

The Spanish competition authority, the Comisión Nacional de los Mercados y la Competencia (CNMC), carried out a dawn raid at the premises of an unidentified pharmaceutical firm to investigate possibly anticompetitive practices in the market for the supply of digital pharmaceutical logistics tools for pharmacies in Spain (see, attached press release in Spanish and English versions). The on-premise inspections took place between 23 and 26 October 2023.
The CNMC did not specify whether its review focuses on the market for the relevant software or rather on the data streams between the pharmaceutical supplier and the pharmacies that are made possible by the software. But its inquiry targets both possibly anticompetitive arrangements and supposedly abusive conduct of a dominant firm.
