Belgian DPA Guidelines on AI Systems and GDPR

With the AI Act grabbing all the attention, data protection authorities are reminding organizations that AI systems also need to comply with the General Data Protection Regulation 679/2016 (GDPR). On 19 September 2024, the Belgian Data Protection Authority (gegevensbeschermingsautoriteit/autorité de protection des données – the DPA) published guidelines on artificial intelligence and the GDPR, highlighting the importance of aligning with data protection principles to ensure that AI systems operate ethically (the Guidelines). The guidelines provide an overview of the relevant principles under the GDPR with which AI systems should align and indicate how Regulation 2024/1689 laying down harmonised rules on artificial intelligence (the AI Act) builds on these principles.
